Acceptance - ALL SALES ARE SUBJECT TO AND EXPRESSLY CONDITIONED UPON THE TERMS AND CONDITIONS CONTAINED HEREIN, AND UPON CUSTOMER'S ASSENT THERETO. THE TERMS AND CONDITIONS CONTAINED HEREIN WILL BE CONTROLLING, AND ANY ADDITIONAL AND/OR INCONSISTENT TERMS AND CONDITIONS SET FORTH IN ANY ACKNOWLEDGMENT, PURCHASE ORDER, OR ACCEPTANCE DOCUMENTS REQUESTED FROM AND/OR PROVIDED BY CUSTOMER ARE EXPRESSLY REJECTED. NO VARIATION OF THESE TERMS AND CONDITIONS WILL BE BINDING UPON BEST BUY INDUSTRIAL SUPPLY UNLESS AGREED TO IN WRITING AND SIGNED BY AN OFFICER OR OTHER AUTHORIZED REPRESENTATIVE OF BEST BUY INDUSTRIAL SUPPLY
Purchaser’s Responsibility - It is the sole responsibility of the purchaser/user to know and comply with all applicable local, state, federal and/or international regulations.
Specifications - Product specifications are subject to change without prior notice.
Risk of loss - All items purchased from Best Buy Industrial Supply are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Delivery - Title of all Products shall transfer to Customer upon delivery of such Products to the carrier. Shipping and handling fees, special packaging materials (e.g., blue ice), carrier surcharges (including fuel surcharges) and hazardous material fees imposed by government regulation may be added separately to the invoice.
Damaged Shipments - Please inspect your Best Buy Industrial Supply shipment upon receipt. If any external damage is noticed, accept the shipment only after the driver has noted the damage on both his and your copies of the delivery receipt and you have requested an inspection by the carrier. Keep all containers and packing material for inspection. If, upon opening a shipment, you find a shortage or damage, you must request inspection by the carrier within the carriers time frame of delivery or you will relinquish your right to make a claim. Best Buy Industrial Supply reserves the right to repair a damaged product, where applicable, before replacement or credit is determined.
Method of Shipment: We generally ship via FedEx. However, we reserve the right to change this method. We make every possible effort to minimize shipping costs.
MSDS: Material Safety Data Sheets (MSDS) are available to all customers. For additional MSDS information please fill out the MSDS Request form on the website or call us during our business hours.
Payment - Master Card, Visa, American Express and Discover, Certified Funds and Money Orders upon purchase.
Shipping Address - Due to the current chargeback policies of Visa, Mastercard, American Express and Discover, our company policy requires us to ship some orders to the billing address of the credit card used to place any order.
Product Descriptions - Best Buy Industrial Supply attempts to be as accurate as possible. However, Best Buy Industrial Supply does not warrant that product descriptions or other content of any Best Buy Industrial Supply Service is accurate, complete, reliable, current, or error-free. If a product offered by Best Buy Industrial Supply itself is not as described, your sole remedy is to return it in unused condition.
Sales Tax - Sales taxes where applicable (local, state or federal) will be added to the invoice price.
Export Controls - Products purchased or received under this Agreement are subject to export control laws, restrictions, regulations and orders of the United States. Customer agrees to comply with all applicable export laws, restrictions and regulations of the United States or foreign agencies or authorities, and shall not export, or transfer for the purpose of re-export, any Product to any prohibited or embargoed country or to any denied, blocked, or designated person or entity as mentioned in any such United States or foreign law or regulation. Customer represents and warrants that it is not on the Denied Persons, Specially Designated Nationals or Debarred Persons List and is not otherwise prohibited by law from purchasing the Products or services hereunder. Customer shall be responsible to obtain any license to export, re-export or import as may be required.
(a) All returns must be authorized by Best Buy Industrial Supply in order to insure proper credit and must be requested within 30 days of purchase.
NOTE: All returns are subject to a minimum 15% restocking charge. For returns not due to Best Buy Industrial Supply error, customer is responsible for all transportation fees related to the returned product. To ensure proper credit, each Product return must include the following information:
(b) Products not authorized for return include: Products not in completely resalable condition (including Products with damaged, missing or defaced labeling or packaging)
(c) Each return shipment of hazardous materials must be packed and labelled in accordance with applicable regulations applying to transportation of hazardous materials. Shipping documents must also meet applicable transportation regulations. When necessary, Customer shall include with each return shipment of equipment, a certification from an authorized representative of the company that the equipment was properly decontaminated in accordance with current regulations and other recommended guidelines. The product should be shipped to the indicated service center and the transportation charges prepaid. To ensure prompt handling, the return authorization number should be placed on the outside of the package.
Authority to Enter Into Agreement - Each party represents and warrants that it is authorized to enter into this Agreement and that in so doing it is not in violation of the terms or conditions of any contract or other agreement to which it may be a party.
